Terms and conditions

1. Introduction

Autoship is a free and advantageous service offered exclusively by J.E. Mondou Ltd. (hereinafter “Mondou”) to members of the Cuddle Club Reward Program, which allows you to automatically receive, on a regular basis, at a chosen address, items that you purchase for your pet, while receiving a 5% discount on these items (hereinafter “Autoship”). These items will automatically be ordered for you on a date that you shall have previously selected (the “Scheduled OrderDate”).

2. Acceptance

a. Your acceptance

By subscribing to the Autoship service, when you make purchases through the Mondou website, you agree to be bound by these Terms of Service, and any other policies in effect on the Mondou website, including the terms of the Cuddle Club Reward Program and the Terms of Sales. If you do not agree with these Terms of Service, please do not participate to the Autoship service.

b. Modification

We invite you to periodically consult the various policies and conditions available on the Mondou website to ensure that you are always aware of the extent of your rights and obligations with Mondou.

3. Terms

a. Customer responsibility

You are solely responsible for managing your Autoship orders. Thus, you are responsible for updating all information related to your Autoship orders including, but not limited to, your Autoship shopping cart, your payment information and your address, and for ensuring that the quantities, Scheduled Order Dates and items ordered are accurate and desired.

b. Billing

The payment of your Autoship order is due on the Scheduled Order Date. The price that will be charged for each item available through Autoship will be the price of each item on the Scheduled Order Date. You agree to pay the total price of your items plus applicable taxes and related fees on the Scheduled Order Date, using the payment method indicated in Section 3i. Mondou reserves the right to change the asking price for any Autoship items at any time, without notice.

The Scheduled Order Date may be changed in certain cases by Mondou, for example if your method of payment has not been established successfully or if the Scheduled Order Date does not exist in a given month. If the Scheduled Order Date falls on a date that does not exist in a certain month, the Scheduled Order Date will be adjusted to fall the last day of that month.

c. Five percent discount (5%)

Provided that you are not in default under these Terms of Service or any other applicable terms or policies, Mondou will apply a five percent (5%) discount before taxes directly to your bill, on the Scheduled Order Date, on any purchase made through Autoship.

d. Automatic renewal

Unless you terminate your Autoship service by no later than the day before the Scheduled Order Date, your Autoship items will be automatically ordered on the Scheduled Order Date. You can expect to receive your order within one (1) to three (3) business days.

e. Modification or termination by the customer

You may terminate your Autoship subscription at any time before the Scheduled Order Date by clicking on “Delete” items in your recurring order, in your online account on the Mondou website, in the section “Plan my Autoship order”. The termination of your Autoship subscription shall take effect immediately.

You may modify at any time before the Scheduled Order Date any information relating to a Autoship order including items, delivery frequency, your contact information or reschedule a Autoship delivery by logging into your online account on the Mondou website. The modification will take effect immediately. To modify your payment information and change or delete a credit card, simply contact our customer service department.

f. Availability

Items that are covered by Autoship are subject to availability. Mondou reserves the right to limit or modify the items that are available through Autoship at all times, in its sole discretion.

g. Out-of-stock items

Any out-of-stock item will not be shipped on the Scheduled Order Date. You will receive an e-mail on the Schedule Order Date to inform you about this. This item will, however, still be considered a recurring item. If this item is once again available at the next Scheduled Order Date, it will be delivered to you in the requested quantity for this Scheduled Order Date.

h. Refusal and limitation

Mondou reserves the right to refuse, cancel or modify, in its sole discretion and without prior notice, any Autoship order, and any associated benefits, that is made in an abusive manner, in violation of these Terms of Service or in violation of all other conditions or policies to which you are subject, in particular by imposing quantity limits or by refusing all or part of an order.

i. Payment method

For the payment of your purchases, Mondou accepts the Canadian credit card, exclusively Visa, Visa Debit, MasterCard and MasterCard Debit. By providing your credit card number, you declare that you are the rightful owner of the credit card or that you are duly authorized to use it by the cardholder. Mondou reserves the right to cancel a Autoship transaction, and any associated benefit, if the provided payment method cannot be verified, is not valid or is not acceptable for any other reason.

Please ensure the provided credit card is valid at all times. You must notify us immediately if your card is stolen and promptly provide a new credit card. Please see Section 3e for more details on information modification.

When you place an order with a Autoship item, Mondou automatically saves your credit card by default. This measure allows to ensure that the payments are accepted on each of your Autoship orders and that you receive your order on the Scheduled Order Date.

j. Return

Please see our Return Policy, which applies to any item return, including the return of items ordered through Autoship.

k. Warranty

Please see our Terms of Sales, which apply to any sale, including the sale of items ordered through Autoship.

4. Limitation of liability

None of the provisions provided in these Terms of Service, including Article “Limitation of liability,” attempt to exclude any liability that cannot be excluded under any law on consumer protection.

To the extent permitted by law, Mondou, its affiliates, directors, officers, employees, agents and representatives shall not be held liable under any circumstances for:

a. Your use of Autoship provided herein (including, but not limited to, delays in the treatment of a modification or delivery of an order for any reason whatsoever).

YOU AGREE TO WAIVE ANY REMEDIES AGAINST MONDOU IN CONNECTION WITH THE Autoship PURCHASES MADE ON THE MONDOU WEBSITE.

5. Survival

The obligations under Article 4 (Limitation of liability) shall survive the termination of these Terms of Service.

6. General

a. Capacity

You affirm that you are of legal age in your province or state of residence.

b. Applicable law and choice of court

These Terms of Service are governed by the laws of Quebec and Canada, to the extent applicable. Any claim or legal action brought in connection herewith shall be brought exclusively before a court of competent jurisdiction of the Province of Quebec, judicial district of Montreal, Canada.

c. Indivisibility and entirety

These Terms of Service constitute the entire agreement between you and Mondou. The nullity of any part of these conditions of service does not affect any other part of these conditions of service which will remain fully in force.

d. Cession

These Terms of Service may not be transferred or assigned by you but may be transferred or assigned by Mondou without restriction or notification.

e. Notice

Any notice hereunder shall be considered duly forwarded when sent to the following address:
